Big Brother

I’m beginning to feel that there are some laws in force that actually make no sense in a civilized society that prides itself on its ethic of freedom (of choice). Your freedom ends where mine beings, and as long as you don’t interfere with my own freedom directly or indirectly, why should I bother with yours?

  • I have still yet to find someone who can explain to me why is it that prostitution is illegal and fornication and adultery are not. Such hypocrisy is positively laughable, because in all three cases there are willing people offering a service and willing takers to receive the same. Whether money, a steak dinner, jewellery or nothing at all is given in return for aforementioned service is a moot point! And criminalizing them all again is a laugable step because the very notion of legislating morality is ludicrous!
  • Why is the Government dictating to me what I can and cannot watch? I heard in today’s news in the morning that the Film Censorship Board Of Kenya will be clamping down on pornography in the country. First of all, not only is this as futile as getting Kibaki to act on anything, it is also laughable because those who have the privilege on MNET can watch unbelievably smutty movies in the wee hours of the night. Again I say, such hypocrisy is laughable.
  • Why is Attorney General ‘Smiling’ Amos Wako telling me that he will not prosecute anyone under the Criminal Libel laws and yet continue to keep the same in the statutes? I refuse to trust my rights to the benevolence of the particular holder of the office! What if a vengeful ass is the next Attorney General? Then what?
  • Why is it that if I run any business of any kind, I must have the current President’s mug staring down from a photo frame on the wall, scaring away small children and animals? What value does this photo exactly add to the business, and what does it prove? That I know who my president is? That I am a Kenyan? Or is it supposed to be some good luck omen?
  • Let’ have some takers!

      Hanging the president’s photo in a business, firm, etc. has always struck me as odd but is perhaps a misplaced idea of patriotism. What happens to businesses that choose not to have this photograph?

      Thinker, you articulately expound about freedom of choice (from a mainly legal aspect, I know:) yet presumably of your own free will, you go and socialise with obnoxious people. What gives? :)

      Circumstances at times can be against you if you are having a conversation with gentleman X and without invitation Y, Z, A and B invite themselves into the same :(

      Just out of curiousity…does the above post represent your opinion on the matter or were you just wondering out aloud? Would be interesting to know.

      On the matter of why prostitution is illegal while yet its just a demand/supply/need as any other business or human need such as when you want some house help you enlist a maid( is that politically correct?) ok house keeper.
      Against the arguement..I think whoever introduced the concept of law esp that one in particular must have been a very smart person..in that they catered both for
      the moral and ethical bit of it.

      Ethical being “system of morally correct conduct”

      Moral being “principles of right and wrong conduct”

      In the sense that the moral part of “purchasing sexual services” was incorporated as the law devoid of any religion or beliefs…and thus a viable representation of every person.

      Thing is freedom without responsibilty is not freedom at all..because freedom in its sense is an individual responisibilty in every person..in the sense that if we all had the power to do as we pleased with no formal laws(set by the govt) to dictate us…we would still be on another level of sub-concious law..meaning our conscience would demand of us to do the right thing. The person who introduced the law made things easier for everybody..instead of going out and buying sex from underage girls who don’t really wanna have the sex but do it for lack of money..then come home and beat youre self up for it..the law made it easier by just saying we shouldn’t purchase sex.

      Human beings are unruly people and as much as you would think that you are responsible for your own actions/decisons as two consenting adults on the matter of buying sex…there are those whose consent does not make a difference..e.g sex slaves in romania/russia or..those who do it against their wishes but rather for need…and since its hard to draw the line or define who really can or can’t do it..its better to make the whole thing illegal.

      Taking a woman out for dinner and buying her gifts in the hope of having sex is in itself prostitution in a disguised way if both parties are inwardly aware of each others intentions…openly buying sex is prostitution..but since its hard to gauge someones feelings in that a man could be trying to show their appreciation to a woman and a woman may be trying to appease their man…its hard to draw the line so it only makes sense if the whole thing was made illegal if you decide to turn it into a formal business.

      I hope you don’t take mistake me for insinuating that you advocate for prostitution…i only took the opposing side of the argument because i am preparing for my ethics exam due in one week…and the only way i can pass is by being able to support both sides of an argument sufficiently despite my personal convictions.
      Now i really have to get back to my “irrelevant” Chemistry homework. :(

      p.s.s Karma- (sunday drink) boy do i miss the sunday drinks..hard to strike greet each other where i live..leave alone a meaningful conversation.

      It doesn’t matter whether I ascribe to the views or not — would it make a difference? As to your issues raised allow me to respond:

      - Your comment ‘In the sense that the moral part of “purchasing sexual services” was incorporated as the law devoid of any religion or beliefs…and thus a viable representation of every person.’ raises issues of laws being pegged to religion. If in my religion human sacrifice is encouraged, then what?

      - I have not said that we should not have any laws — I said that some of them were suspect and interfered with my freedom of choice and to make my own decisions.

      - Sex with underage girls is pure and simple child abuse, so the legality is a moot point. I’m talking about sex with consenting adults.

      - When you raised the issue of sex slaves in Russia you’ve danced around my point. Again, I said consenting adults. Insofar as she is unwilling to participate then it ceases to be consenting and becomes rape, and is now infinging on her freedom, so again that is a moot point.

      - Your assertion that there are cases where lines are so blurred that it is better to ban everything would precipitate a Puritan society. Following that argument I can say that pangas, hacksaws and bread knives can be used to kill. Therefore just to be on the safe side, everything that has a blade is illegal
