The Kadhi Courts: How Opportunists Polarize A Nation

If you have not received a certain email from someone purporting to be a devout Christian analyzing the Kadhi courts you will soon. I myself received it this morning and have spent the day trying not to work myself into a rage. This email is quite simply a daring attempt to polarize our country’s Christian and Muslim populations.

Why was I trying not to work myself into a rage? You see, I got similar emails in 2007 only instead of Christian and Muslims it was Luo/Kikuyu Meru/Kalenjin etc. Kenyans have foolishly and amazingly forgotten just what happened when a people are polarized.

What maddens me is that this email while on the surface looking like written by a well meaning Christian was undoubtedly written by someone extremely intelligent. Why I think this I shall disclose as we go along.

Since the email purports to be based on facts, all of which can be demonstrated to be false, I shall attempt to debunk the absurdities that I have seen.

The email itself opens as follows:

URGENT

THE SHOCKING TRUTH ABOUT CONSTITUTIONAL KADHI COURTS and THE ABORTION CLAUSES

PICTURE THIS

Immediately below this is a small hypothetical narrative. From my little knowledge of psychology and human nature, that narrative is there to put the reader in a certain state of emotion. For my purposes I shall conceal the narrative for now and reveal it a bit later.

Then comes the bunkum

LIES THE MEDIA IS SPREADING ABOUT THE CONSTITUTIONAL KADHI COURTS AND ABOUT ISLAM

LIE NO 1. – The Kadhi courts have been retained in the proposed constitution as they are in the current constitution. This is a blatant lie. Nothing could be further from the truth. The truth is that the jurisdiction of the Kadhi court in the current constitution is restricted to the 10 mile coastal strip stretching from the Indian Ocean. This was the territory that formerly (before independence) belonged to the Sultan of Zanzibar. This area did not belong to the British and was therefore referred to as the British Protectorate. This area is currently referred to as the former British Protectorate. Furthermore in the Bomas Draft and in all other drafts except the Proposed Constitution, the jurisdiction of the Kadhi court is restricted to this 10 mile coastal strip. In the Proposed Constitution the jurisdiction of the Kadhi Court will be nation wide. I hold that there is a big difference between a ten mile coastal strip and nation wide.

Here we have a very clever attempt to influence the mind of the reader. The premise is if you surround something with facts, the something you have surrounded with the facts gains credibility. 10 mile coastal strip? Not in the constitution? Complete nonsense. From the judiciary website:

Kadhi’s Courts are established under section 66 of the Constitution. Their operations are regulated under the Kadhi’s Courts Act (Chapter 11 of the Laws of Kenya). Kadhi’s Courts deal with matters relating to personal status, marriage, divorce, inheritance in proceedings in which both parties profess the Muslim faith. Kadhi’s Courts are subordinate to the High Court.

There are fifteen (15) Kadhi’s Court stations in the country, namely, Mombasa, Garissa, Lamu, Marsabit, Bungoma, Kisumu, Isiolo, Eldoret, Wajir, Nairobi, Nyeri, Nakuru, Kwale, Hola and Malindi.

Just so we’re clear. Kadhi courts are in the constitution and are not limited to a 10 mile coastal strip. Further more their jurisdiction is clearly limited.?

LIE NO 2. – The Kadhi court will not affect you if you are not a Muslim. This is a barefaced lie. You must not believe it. The courts will affect everything in your life. You may even find yourself without a place of worship as in the story above. Your taxes will pay the Kadhi and his staff. If each Kadhi gets a million and you add construction and other expenses, they could be taking off a clean 20 Billion from our national budget. They will use GK vehicle, they may take your land for construction of the courts.

Notice how the author has started by arguing it is a barefaced lie and burning the reader not to believe it. Author then goes on ahead to provoke by saying the courts will affect everything in your life and you might find yourself without a place or worship as the story above. The author then seamlessly states that our taxes will pay the Kadhi and his staff. This might actually be true, given that for all intents and purposes Kadhis are actually civil servants. But then again taxes will always be used to pay civil servants. The author then switches to provocation about paying the Kadhi a million and then with fascinating arithmetic claims Kadhi courts will cost 20 billion. Author then asserts your land may be taken to construct the courts.

Notice if you may not a single fact has been raised to back these absurd allegations. Why is it a barefaced lie? How will it affect everything in your life? Even for Muslims the courts do not affect everything in their lives. I remind you: in the law their jurisdiction is limited to personal status, marriage, divorce, inheritance

LIE NO 3. – The Muslim "brothers are friendly people who mean no harm". This is the biggest lie of all; Muslims are sworn enemies of Christians. Their faith encourages them to lie to kafiris. (Non- Muslims) and to kill kafiris who get in the way of their religion. In Islamic nations, like Pakistan, a Christian can be arrested and jailed for preaching. Here in Kenya, we seem to be rolling the red carpet for the Muslims. Take a look at the Islamic nations around us; see the kind of violence we are inviting.

I’m still not sure if this warrants the dignity of a response. Sworn enemies? Kill Kaffirs? Laughable. I urge all Christians with an iota of sense not to believe half truths peddled via email. Buy, or better yet, download and read a Koran for yourself. Having done it myself, I highly recommend it.

As for violence in Islamic nations — there is plenty of violence in Christian nations, starting with this one!

LIE NO 4. – That having Constitutional Kadhi courts in Kenya is purely for sorting out family matters between practicing Muslims. This is also a lie; the plan of constitutionalizing the Kadhi courts is a part of the Abuja Declaration for the Islamatization of Africa. It is not an isolated incident. It happened first in NIGERIA. Today in Nigeria, pastors have to buy guns and hire people to guard churches, but our "Muslim brothers" are still managing to burn some of them.

Just to refresh: the jurisdiction of the courts in the law is personal status, marriage, divorce, inheritance. Nothing to debunk there. As for the Abuja Declaration quoted, this is it. I don’t see anything about Islamization of Africa. And if, for hypothetically, there were, what’s wrong with that? All religions wish to spread their faith. As long as its not by force, what would be the problem?

LIE NO 5. – That all religions will be equal before the eyes of the law. This is the mother of all lies. The CEO deleted the clause" THE GOVERNMENT SHALL TREAT ALL RELIGIONS EQUALLY" This clause was present in the bomas draft , and in all subsequent drafts, but it was deleted by the Muslim headed COE to make way for the elevation of Islam from the proposed constitution. Christians be warned, the only religion in the proposed constitution is Islam. Christianity doesn’t even get a mention. Do not be deceived, they are trying to sneak in Sharia Law through the back door. Ask yourself, why would they delete this clause unless the opposite is true?

This is complete nonsense. The clause is in fact in the COE draft. See Chapter Two 10 (iii). The bit about Sharia law through the back door is absurd and is a leap defying logic.

LIE NO 6. – That the amendments can be done after the referendum. This is probably the most shameless lie of all. The truth is that one requires a million signatures to petition a clause, a 2thirds majority in both the upper and lower houses and a referendum to change a single clause in the Protected Articles. Kadhi courts fall under the article on the judiciary which is protected and Abortion fall under the Bill of Rights which is also protected. They are making a fool of us. If we swallow this, they will soon be laughing all the way to the Consolidated Fund and the Treasury.

Changing the constitution indeed requires quite a bit of effort. This is not necessarily a bad thing, because we all know politicians are wont to change the law to suit themselves. I will research on what exactly it takes to effect a change because I refuse to believe what this author writes. I will update this section in due course. What I can laugh at right now is the leap in logic to Muslims laughing to the Consolidated Fund and the Treasury.

LIE NO 7. – This is the best proposed constitution so far, the let church not be a wet blanket by spoiling it. This is merely a guilt card and they should know better than to pull this one. This is not the best constitution so far, in fact it is the worst. It has a host of hidden clauses insert by individuals and groups of individuals with sectarian interests. These clause are so disguised one requires an international law degree just to recognize them. Take the clause on abortion for instance. This is the same clause that was used in the UK to legalize abortion. Whoever came up with the clause must not only be well informed but also very conniving.

Whether is is the best or the worst is entirely subjective. Let people read for themselves and decide this. Let them not be pontificated by anyone — not MPs, not the Church and certainly not absurd emails. The nonsense of hidden clauses leaves me amused. How can a clause be hidden? Invisible ink?

The abortion clause that allegedly requires an international law degree to understand is this one: Chapter 4 25 (4)

Abortion is not permitted unless in the opinion of a registered medical practitioner, the life of the mother is in danger.

The author then attempts to give some commentary

SOME ALARMING DEVELOPMENTS HAPPENING IN KENYA AS YOU READ THIS

Do you know why government is yet to release the results of the census which ought to have been released ages ago? The reason is not only shocking, but alarming. It is because persons of Somali ethnicity now out number any others in Kenya. Experts are saying this kind of increase can only be explained by immigration not birth. In a case of too little too late, the government has now stopped admission of children into public schools without birth certificates to curb illegal immigration. The question is, what about all those Somalis that now hold illegal ID, what they are going to do about them. The government has already lost cases in court against these illegal ID holders. Our courts appear to hold the view that a national ID is sufficient proof of citizenship Somalis are 99.9% Muslim. As you read this, these illegal ID holders are now busy being registered en mass as voters by a Muslim headed IIEC. You still think all is well?

No one is disputing there is an issue with immigration. But how is it alarming?

Have you noticed that mosques have multiplied ten fold in our neighborhoods in the last 5 years?

Utter bollocks. This means that where there was a single Mosque there are now 10, the other 9 being built in the last 5 years. Laughable

Have you realized investment by Muslims and Islamic countries have also increased ten fold?

I challenge the accuracy of these statistics. And even if they were true, what’s wrong wth investing? Aren’t Christians and Ogieks investing as well?

Are you aware that the head of IIEC, the PSC, and the COE are all Muslims?

The first two perhaps. The third? And even if it was the case, so what? Suppose they were all Christians. Would their credibility change? Should it change?

Are you aware that our beloved Prime minister has some kind of pact with Muslims?

Are you aware that our president as well has some kind of pact with ISLAMIC COUNTRIES?

Both these long in sensationalism and short on facts. Which pacts? Which countries?

This can only mean Kenya has been targeted to become an Islamic haven. This ought to make you very worried. They now have the voting power and the money. They are also very united and extremely good strategists.

Not the way the clever author sweepingly concludes that Kenya is to be an Islamist haven. How, pray tell? All the ‘lies’ and commentary above had the purpose to put the readers in an emotional state of fear and distrust. And just to make sure, author says you ought to be very worried. To now culture an image of subterfuge, author allides to them being united and good strategists.

Social engineering at work my friends! Brilliantly executed.

Have noticed the increase of incidences of demonstrations conducted by Muslims for the most minor reasons?

Aside from the ones for the Jamaican, and the one for Grogon, which one? Not also the use of ‘most minor reasons’. Demonstrations are common in this country. Everyone demonstrates! Nurses, doctors, Mungiki, teachers, mechanics…

Did it capture your attention that for the first time in Kenya, we had demonstrators using guns to attack security officers? Tellingly this was a peaceful demonstration by our harmless "Muslim Brothers". This ought to worry you.

How is this new? Mungiki, Sabaot LDF, SunguSungu etc have been doing this for years!

Did you know that according to a recent UN investigation hundreds of Kenyan Somali youth are now fighting alongside the insurgent AL-SHABBAB against the TFGORVERNMENT of Somalia? Do you realize that if history is anything to go by, these youths are likely to come back home and use their experience to instigate plan and execute a parallel insurgency right here in our own country. If this doesn’t worry you, I don’t know what will.

Which investigation? Give us the report. And even if it were, the talk about parallel insurgency is just alarmist. To cement to emotional state of the reader is the helpful guide ‘If this doesn’t worry you, I don’t know what will.’

Are you aware that our politicians having noticed that the landscape is increasingly Islamic are now falling over themselves to make pacts with Muslim leaders in order to secure their political future?

Proof? Which politicians?

Are you aware that you are now the last hope in this war? The politicians have failed, the civil society has failed, the professionals have failed, and the experts too have failed.

Now this I agree totally insofar as consensus building is concerned.

WHAT CAN I DO?

Register as a voter and wait for the referendum.

Agree totally!

Send this email to all Christians you know including the one who sent is to u. you must do this with urgency. Time is far spent and we must inform all before the Islamic propaganda gets to them.

Print out this email and make copies for the friends you have who have no email. Please do this with utmost haste. The future of the future generations of Christians depends on us.

RUBBISH! If you become party to forwarding this email my friend you will share the responsibility in the attempt to polarize this country.

Also, no sincere Christian can possibly have composed this email. Which Christian, so soon after Easter to boot can remotely associate the hate and deception peddled in this email to the words and teaching of Christ?

Edit the article to your suitability (Add facts I may have omitted or clarify others) and resend to all Christians you know. And please hurry and do not delay.

I just have.

Keep the article away from Islamic headed commissions and committees and from the Islamic Nation Media.

And there you have it ladies and gentlemen. Someone purporting to be a Christian stoking the embers of a divided nation.

If you still remember the horror of 2007 you will do your best to arrest this absurdity and talk to those who believe it.

Now, the story that this email opened with

It is five years from now and the Kadhi courts have been operational for the same period. Your uncle is crying, the government has just forcibly repossessed his land and is planning to compensate him for less than his land’s worth. He seeks your advice about taking the government to court to get market rate on his land but you advise him against it. To your surprise the government begins to construct a mosque on what was formerly your uncle’s land. On completion you are informed it’s not a mosque but a Kadhi court. It begins operation and the compound is full of GK vehicles. A convoy arrives with GK vehicles complete with GK drivers and GK body guards. What appear to be Muslim clerics disembark from the GK vehicles. You are informed that these are the khadhis. They are now government Islamic judicial officers (what a contradiction, you think). You draw nearer to get a closer look and the guards inform you that this is an Islamic institution and you should therefore keep off. You leave wondering how your constitution came to allow the government (Kenya now has a Muslim president) to build and fund a Muslim religious institution.

You go to church the following day, eager to share what you have seen with fellow Christians. You find the gate locked and a big crowd outside. You notice the Pastor and you draw near to him. He tells you and others that the government has closed the church because of its proximity to the Kadhi court. He has been informed that the court is constitutional and the church is not, therefore the church must give way. He may rebuild the church at an appropriate distance so as not to disrupt court proceedings, and no, it doesn’t matter what came first only what is constitutional.

This is clearly designed to provoke the reader into a heightened state, a state that will influence the reader to believe the tripe that follows immediately after.

And to the author of this email — you are a very clever individual indeed. Why you want to take this country back to where we were in 2007/2008 only you and your maker know. If only you could put that brilliant mind to the service of this nation!

I hope you will reflect on what you are doing. It’s not too late!

As for me personally I have no problem with Kadhi courts. I do not believe they affect me. Their jurisdiction is limited. They serve a need in cases where the law is grey. For example Islam allows more than one wife. The law does not, unless in the context of either Islamic law or traditional law.

    The media should give a blackout to all politicians and religious leaders commenting about the proposed constitution, whether for or against. Let’s read it for ourselves and get our own opinions. The 2007/8 chaos started with the country being polarised during the 2005 referendum. Not again.

    The sheer amount of vitriol and mis-education expressed in this email is shameful but frankly not shocking, I have watched as everyday Kenyans have gotten converted into intolerant bigots by “religious leaders”.

    I go to church and hear he same sentiments expressed in the email being spouted from the pulpit, I have watched as family members debate using arguments that can be debunked with simple searches in Wikipedia and history books. I have tuned into T.V and watched as Televangelists preach this same message with a tilted view on news that borders on outright lies.

    There will be people who will receive this e-mail and will believe every word in it without bothering to research and there are those who will make excuses for the authors of this despicable piece of literature.

    One institution which transcends tribe in Kenya is religion and it was almost our last hope, If our sectarian divisions are the ones being exploited now, what lays in store for us?

    I shudder to imagine.

    I got the same mail this morning and i was pissed coz a fully grown up person thot it was brilliant to fool kenyans.I personally urge everyone to read the draft n be wise come the referendum.

    IMHO this is the season of polarization, Yes vs No. It is also the season of propaganda. It is also the time when more propaganda is used to debunk propaganda. Too bad it will be religious this time. That is the nature of voting.

    It is evident that some christians are not happy with the draft and they will vote no if their position is not reflected in the draft, however ridiculous it is to some people. Again IMHO they are entitled to their position and voting.

    Fundamentally, christians and muslims have parallel and irreconcilable differences in their core faith and each believes in the supremacy of their religion over the other. They each aggressively “market” their positions by all means necessary if history and current events in countries such as Nigeria, Sudan and middle east is anything to go by.

    I am sure this email is not the last we will see as Kenya enters the era of religious intolerance, it is here to stay and worse is waiting ahead I am thinking.

    You say “Kenyans have foolishly and amazingly forgotten just what happened when a people are polarized”. In my understanding, it implies violence aka 2007 elections. That if a ‘no’ christian vote prevails, there is a chance that muslims will retaliate violently and vice versa.

    The ‘popular’ thinking to avert this crisis is for the christians to back down their demands and leave the kadhi courts alone since they can spark Kenya to fire again and they have been in the constitution anyway.

    The christians have also an interesting perspective to this; why cant we remove any (christian/muslim) religious reference in the constitution and leave each religion to fend for itself? also that the review was to correct what was wrong and to THEM kadhi courts were wrong from the beginning and now that we have the chance to change the constitution they should be removed. Aren’t they entitled to their position?

    IMHO if kadhi courts and abortion, though constituting a small % of the draft, are of such polarizing magnitude and threaten the new constitution, let them be removed from the draft, we pass the draft without them unanimously and have the two renogotiated by the stakeholders and later enacted. After all we can change/ammend the constitution thereafter.

    @Twocents everybody is fully entitled to disagree with the draft and reject it in the referendum. In fact its an important civic duty
    What many are finding objectionable is the manner propaganda is being spread especially in this email where dubious statistics and scare tactics are being used to paint a minority group as being a danger to the country

    I had not received this before, thanks for posting. Words fail to express the sheer disbelief and rage that I went through as I was reading through it. How can one purport to be a christian while peddling such blatant lies and hate of such magnitude? I received similar emails pre-2007 General elections even from relatives but this time discrediting one tribe from the other;I don’t need to remind anyone what happened after that. I know that the Constitution is an important document to this country, but pray, do we have to stoop this low to have our vote win the day? I will also make a point of putting anyone who dares forward me such an email or anything similar to it in their place

Under criminal law, this is what we call Malice Aforethought, he has sat down and thought of a way to get communities to clash and then sits back and waits for the communities to kill each other, he is actually worse than the actual perpetrators of the violence!     Let the same idiot inform you of the backlog that is going to occur should all personal matters dealt with under the Kadhi’s Court be lumped with the normal court. Let him inform you of how he wants that dealt with! The law is clear, Kadhi’s court have limited jurisdiction to deal with Muslim’s personal matters as stated in their Holy Book, since to them, Islam is not only a religion but a way of life! How then does an idiot such as this presume to indicate that the way the Islams deal with their personal issues is a matter of National Security??????? How a person is buried, or how his personal property shall devolve upon his death, divorce matters, how is that a threat to the people of Kenya and how does it make a Muslim more superior than a christian? Don’t Christians have the Marriage and Divorce Act? Doesn’t personal, customary law have a bearing on our courts (SM Otieno’s case), you don’t hear the Muslims bitching that the Christians have it made!
    Personally, I vote for finding this yahoo and……………….. and I am still not able to come up with best punishment….I am working on it!

    In my humble opinion, your criticism reflects the cowardice that has entrapped the Christian Church and Kenya in general. It is also driven by
    the neo-pragmatism (bordering on narcissism) this is present in the Wall Street ad high finance culture – “…As for me personally I have no problem with Kadhi courts. I do not believe they affect me…”
    1. Constructive criticism is about separating truth, halftruths and lies and proposing a better way forward. Not only is your article a criticism everything written here, but it represents “burying your head in the sand” on important issues.
    2. I lived in an estate and blatantly through most of the evenings, I heard with my own ears, a Khadhi talking about Islamisation of Kenya and the rest of Africa. I noted you did not mentiona anything on the Abuja declaration. Did you know the problem is South Sudan was the agenda to islamise and arabise the Sudanese – I should know having had an active participation in some capacity.
    3. So, why have the Khadhis courts in the constitution, why not register them like any other common interest, self funding group. Why not have Mungiki, Musambwe, Salvation Army and Jehovas witness in the constitution too?
    4. I believe the poligamy dilemma is addressed in clauses related to marriage.
    5. It is narrow minded to believe that “Muslim Investment” is purely economic. Do we forget that Islam is a culture…did you read about Gadaffi proposing a split of Nigeria after the recent riots? It will be instructive to do your research on how they got here in the first place. Islam thrives
    on “terror” with the full knowledge that they can intimidate anyone to their agenda and threaten anyone who questions their practices.
    6. It is crazy cawardice to avoid addressing moot issues for fear of “polarising” the nation. It is like pretending problems will go away if left unaddressed of if we drunk one more bottle of beer – my friend, the emergence of the USA as an economic powerhouse is driven by the principles of their founding fathers. A constitution, like a personal policy framework, allows making strategic decisions in the course of everyday life. It
    impact is long-term and deep. Considering the difficulty in securing ammendments and wickedness in national leadership, it is better to nip
    unpleasant developments in the bud.
    7. It is ridiculous to disregards the noted prescence of muslim officials on the governance hierarchy. Is it by coincidence…did you notice the increase in islamic activity around the appointment of Obama?
    8. The statement of having everyone read the constitution for themselves if really wanting. Do you know that democracy really does not work in Kenya (or Africa for that matter) because the citizenry lack the capacity to objectively examine policy matters…hence re-election of mis-performing MPS. They need guidance or some discourse as attempted by the author.
    9) As for abortion, I believe life starts at BIRTH and ends at NATURAL DEATH. Else the government should have a “placenta bank” to incubate unwanted foetuses.
    10) The immigration issues raised are indeed moot and deserve urgent addressing. The function and allegiance of the state is to its people and any immigration/investment/policy making that undermines or suboptimises the long-term well being of the citizenry is a moot issue.

    Further, there are two ways to amend this Constitution. The first is amendment by Parliamentary initiative (Article 237); two thirds in both National Assembly and Senate suffices. The second is amendment by Popular initiative (Article 238), which is as the author of the email describes. So in stating that amending the document is very difficult, he’s telling only part of the truth. The truth is that amending the document by Popular initiative is very difficult. The Parliamentary initiative route is less circuitous.

    @Foresee I would like to disagree on #8 that ‘the citizenry lack the capacity to objectively examine policy matters…..’ that is an extremely self defeating argument & a tad bit insulting. I will personally read the constitution and ‘examine’ it regardless of my ‘limited’ capacity and make up my mind regardless what my MP, Priest, Imam, Rabbi, President etc say.

    Its amazing to see all of you radically dissecting the email,the constitution etc. “Let those without sin cast the first stone” – The good Book says. As we comment on the constitution and other political matters let us lead by example. Let us watch our language, agree to disagree when our perspectives don’t converge and end our comments with on reconciling tone. Whatever happens this is our country and we are not fleeing anytime soon.

    Why not carry ourselves this way not only for our sake but for the sake of the next generation watching us.

    The referendum is not a competition its platform for people to express their opinion and rights after which the majority will take the day and then we go back to nation building.

    A lot of challenges face us and lets not be deceived that the constitution will fix all of our problems. It will just lay part of the foundation. Ethics, honesty, hard work good morals etc will complete this foundation.

    In a nutshell we have a country to build after the referendum. 2007 taught me that. After all the chips fall where they may let my one year old daughter look back and speak with the same respect we do when we talk about those who shed blood to free our country in 1963.

    am a christian, and very open minded. i just received the mentioned email this morning and somehow landed on this page hoping to get detailed facts as to why the email is a hoax. now i agree that the email is crafted with much sentimentality and designed to provoke emotions, and am not forwarding it to anyone.

    am disappointed with your write up, though, because i didn’t get the facts i was hoping to get (except a few here and there). could u give us facts too? instead of saying stuff like ‘this is nonsense’, ‘rubbish!’, ‘utter bollocks’ etc etc… please cut that crap and give facts disputing the email’s content. if anything i find u agreeing with more that is in the mail than disputing, like ‘yeah this is true to some extend, but…’

    and even when u dont have facts u say ‘i refuse to believe what this author writes…’ so are you refusing because of facts or just coz u want to refuse?

    Good point. I would be the first to state that leaving lawmaking and reform in the hands of MPs is retrogressive. Their efforts (if they can be called that) to pass amendments are an excellent case in point.

    However, to imply that the only way to change the Constitution is the way of Popular initiative is to lie by omission. It amounts to selectively quoting the Constitution to contribute to the fear that the Constitutional reform process is irreversible. Why not tell readers that there are two ways to change the Constitution, but MPs being what they are and Parliament being what it is, the former way may not be viable?? To me that is more honest.

    As a Christian I would certainly prefer it if the Kadhi courts were not in the draft. But to descend to the methods used in this mail really is to detract from our cause. Dignity and respect for the truth (and indeed, for the opposing view) need not to be cast to the winds in an effort to win support. While the Moslem is not my brother, spiritually speaking, he remains my fellow-citizen (in all instances) and my friend (in most). I believe we should put our points across respectfully, but firmly. Truth does not need dressing up; it can stand up for itself. Such scaremongering as is contained in this email should be beneath any and all Christians.

    Kadhis’ Courts

    (b) possesses such knowledge of the Muslim law applicable to any sects of Muslims as qualifies that person, in the opinion of the Judicial Service Commission, to hold a Kadhi’s court.

    (3) Without prejudice to Article 154, there shall be such subordinate courts held by Kadhis as Parliament may establish and each Kadhi’s court shall, subject to this Constitution, have such jurisdiction and powers as may be conferred on it by law.

    (4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi and such of the other Kadhis (not being fewer than three in number) as may be prescribed by or under an Act of Parliament, shall each be empowered to hold a Kadhi’s court having jurisdiction within Kenya.

    (5) The jurisdiction of a Kadhi’s court shall be limited to the determination of questions of Muslim law relating to personal status, marriage, divorce or inheritance in proceedings in which all the parties profess the Muslim religion and submit to the jurisdiction of the Kadhi’s courts.

    Just as added info, the Superior courts are the Supreme Court, High Court, and Court of Appeal (Articles 147-150).

    Those articles are 169 and 170 in the Constitution revised by the COE after the PSC draft. However, the articles remain largely the same in wording, differing only in article 3.

    PSC draft:

    Please cut the crap and state facts. I dont agree with the email or its style of causing fear and panic but in dissecting it, you missed crucial facts.

    1. You are using the harminized draft instead of using the Draft approved by parliament. A number of clauses were deleted before it was taken to parliament

    2. You say it is utter nonsense to say that all religions shall be treated equally. You go ahead and quote a clause that was long deleted. The draft Parliament approved and which is what is headed to the referendum does not have Article 10 (iii)

    Please read through the Parliament approved draft before you try to present a view point. I have read it and compared it to all other drafts and the current constitution and by reading through your blog, I can tell you haven’t because you keep quoting the wrong articles.

    I am a born again Christian, staunch believer.I may or may not support the Kadhi courts, but comparing the email, which by the way i received yesterday, and your analysis M, I like your approach, which is constructive criticism, with reduced emotion and increased presentation of facts.

    I have researched widely on the question of Kadhi courts, and definitely the only difference between the current and proposed constitution is that the current one shifts jurisdiction of the Kadhi courts from the FORMER PROTECTORATE to WITHIN KENYA. I need two documents, one, the one that defined the Geographical boundaries of the Protectorates, and two, THE KADHI COURTS ACT.Then I will be in a position to present my facts.

    First and foremost, Christians have a right to be heard and protected no matter what goes. This is a right that should not be frustrated no matter what. Secondly, the aim of a constitution is not to divide but to come out as a more unified and strong nation matching towards maturity and prosperity. On this I disagree with @twocents who said that this is a season of polarization. If indeed it is, why are we all looking for consensus. We would be busy pulling each other down and setting the stage for 2012 in unmeaningful supremacy contests.

    This takes me back to my first point, if everyone is to be heard, then we need several constitutions to cater for all interest groups. However this is not possible. Whoever wrote the mail, did it with extremism in mind just as practiced by Al Shabaab /qaeda. We should be looking for ways to protect those whose views were “ignored” such as ensure that no matter the leadership, the constitution will not be abused by the rulers be they Christians, lawyers, Muslims, Kikuyus, kamba etc. That is to ensure that Kadhi courts remain as they are. A court for Muslims on only family matters and not a national court as purported.

    finally, let every Kenyan willingly exercise his will without influence from booklets, hate mail, propaganda, politicians clerics, scholars etc. However, they have a right to be heard

    @kaymedia, you can get the Kadhi Courts Act at http://www.kenyalaw.org search for kadhi courts and you will get it. You can also get the current constitution there. In the act you will find that currently there are 8 kadhi courts in Kenya all over Kenya not only the 10 mile coast strip. 3 in coast, 1 in Nairobi/central area, 1 for Nyanza/Western/Rift valley, 1 in Wajir/Mandela, 1 Garissa/Tana and 1 in Marsabit/Isiolo.

    @bonez, unless you want to bury your head in the sand, it is clear that we are headed for a religiously polarized referendum since as it stands the draft is headed for the referendum without further amendments, unless the church leaders back down. Already Raila and Kibaki are out there campaigning for yes before the COE can even embark on civic education and before a majority of Kenyans can register as voters. The draft as it is, is unstoppable.

    Second: – I wish to argue on the funding of the Kadhi Courts, who pays the Chief Kadhi and the other Kadhi’s? If its the government, then there need to be good justification for this spending, which is a recipe for inequality…and third:
    Why was the religions equality clause deleted from the draft?

    Equally, there is a pending case in court challenging the legality of the Kadhi court Act, and the ruling has been delayed beyong the legal forty something hours!!!am almost tempted to start being extremist, guess this is where it starts..!!!

A friend of mine who has been to Prisons tells me that while Christians are allowed to have Chaplain and Catechist whose offices are fully supported by the government; none is provided to the Muslim and other religion. Is it true? If our Muslim brothers are not given equal support as the Christians then this sad since we all pay taxes.

    When views were being collected on Constitutional making all and sundry gave their proposals including the x-tian clergy. At one point the religious fraternity was asked if they needed any form of jurisprudence to be included in the constitution since the Muslims already enjoyed such a status. The Hindus backed away claiming they were satisfied with the existing set up so did the Church delegations. Now they (Church) are asking for an “even” playing ground by the removal of Kadhi Courts, absurd! Why didn’t they seize the opportunity when it came their way by coming on board? As a Muslim I wouldn’t have had any objections since Kenya is for us all. Jealousy is the in thing here. If the Kadhi Courts are actually deleted as the X-tian clergy are supposing. We Muslims will have 1001 queries on the Constitutional favours the X-tian faith has been given by our constitution more than any other faith in this country. We will also want to know about the fate of the International Treaty which allowed Kenya to take in the Coastal Strip and its consequences.

    Before one makes a definative stand on the kadhi’s court It’s important for us to understand clearly how we came to have Kadhi courts came into being……. ……

    Historically, Kadhis Courts existed in the East Coast of Africa long before colonization. In Kenya, they existed in the Coast.In 1895, the Sultan of Zanzibar gave the British power to administer the 10 mile coastal strip subject to their respecting the existing Kadhis Courts among other conditions.During the last years of the independence struggle and at the start of the Lancaster House Constitutional talks in 1961, the status and fate of the coastal strip came up for determination,opinion was divided as to whether the coastal strip should join Kenya, or be declared independent on its own, or reverted back to the Sultan of Zanzibar.The British organised separate talks for the delegates from the protectorate of the coast and those from the Kenya Colony.Eventually it came to pass that in October of 1963,the Sultan of Zanzibar relinquished/ surrendered his claim of sovereignty over the coast to Kenya in return for mzee Kenyatta guaranteeing the continued existence of the Kadhis Courts among other guarantees. When the independence constitution was written, the Kadhis Courts were enshrined under the chapter on Judiciary.

    Therefore… ..The constitutional recognition of Kadhi courts is necessitated by Kenya’s legal obligation to guarantee them in exchange for receiving sovereignty over the Coastal Strip,

    This was a trade off, – way back in 1963

    Contrary to what happened in the coastal towns such as Mombasa, the Kadhi’s Court of Nairobi was created relatively recently it was only after independence that a Kadhi’s court was established, at the end of the 1970s.

    One of the arguments advanced for the creation of the Kadhi courts is this what we asked for…..in going around collecting views from Kenyans CKRC faithfully reflected what they recieved from the general public which was this what Kenyans recommended to the CKRC…..The Commission’s mandate under the Law is to collect, collate and analyse the views of Kenyans on changes to be made to the constitution and to recommend amendments or other changes thereto which faithfully reflects the views and wishes of Kenyans.

    The commission was to study the judiciary, among other institutions, and seek people’s views on how the judiciary could be improved. The Kadhis Courts are part of the judiciary and the legal systems. When the commission issued “issues and questions” for public hearing to guide the people in the collection of the views, the same contained questions on what was to be done to the Chief Kadhi and Kadhis Courts. Many of the people, organizations and experts who gave views on the Kadhis courts did not at all question their existence but advocated for their retention with some improvements or modifications. In recommending improvements to the Kadhis Courts, the commission was faithfully reflecting an analysis of the views it received, What is not being made clear is The Muslims generally asked for the enhancement of the role and status of the courts while in some cases like in N.E. Province, they asked for the full application of Sharia Law in their areas.

    Yes – Sharia law

    The commission did not receive any views for the creation of courts for Jews, Hindus or others, that would go without saying, the christians and other faiths recognise that Kenya is a secular country with a clear separation between church and state, the Muslims on the other hand have an agenda….and from pre-colonial times have always advanced this agenda

    The Kadhis Courts do not exist in Kenya alone. Several countries in Africa and the Commonwealth that have a significant population of Muslims provide for these courts in their constitutions and Laws to cater for the regulation of the personal status of their Muslim Citizens.Without definative proof and excluding the North Eastern Province, would it be a safe assumption to assume that Kenya has a significant population of Muslims? – infact let’s pause here for a second to ask ourselves

    - Do we all appreciate the “islamisation” of our security agencies under Moi? this was done precisily because a military headed by a minority and it’s infrantry staffed by a minority could not pose a threat to his regime
    - Do we all appreciate the radicalisation of the North Eastern frontier? do we know that in Somali we have Youths being trained to fight a jihad against Kenya?
    - Why is it perfectly acceptable for Sudan for example to have Sharia law? if it’s because it’s got a signifcant islamic population and therefore a muslim country what makes on think that in the coming months this is something that won’t be advanced in Kenya too…..why do we make exceptions for our muslim brothers? why is it in order for a Mosque to be built in residential areas? how many of us get woken up by the Muslim call of prayer? have you tried having a rational discussion with a muslim friend why it’s ok for thier way of worship to be disruptive to other faiths?
    - Why is it perfectly ok for Islamic clerics to to argue the retention of Kadhi courts but politically incorrect for christian clergy to say no

    No non-Muslim suffers any harm due to the existence of Kadhi courts, but they mean much to Muslims…This is patently false…..the Kadhi courts will not be the end of this agenda…it’ s just the beginning,We are told the Church’s duty is to preach peace…really? i would have thought the church’s duty is to preach the gospel, the State’s duty is to protect it’s citizenry, Kenya might not be a christian country, but i know it’s a secular one.

    And that is why on this “contentious” issue my vote is NO

    I have read the engagement between the writer of the email and the initial responses keenly.
    I do not want to dismiss the writer nor the responses. but the question am raising is,” why is it that the Muslims have great interest in the Kadhi court being entrenched in the constitution?. why should they elevate themselves more than the other religions?
    having studied in-depth the emergence and development of Islamic religion in the world all the way from middle East, I believe the elite Christians have logic to take their stand. I also infer the implication of their position is fueled by the global politics of religion, whereby the westerners have portrayed Islam as a religion of violence(terrorism). we boarder somali and Sudan yet we see the effects and activities of Muslims.

    today it was announced that DSTV has been banned from airing its programs to some parts of Northern Kenya. What will people read from this ban? the ban is so untimely because now those who are agitating for exclusion of the Kadhi courts will be energized by this move.

    First you are wrong that Kadhi’s courts are operating legally outside the 10 mile coastal strip. Section 66 (4) of the Constitution is clear on this and states;

    (4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi and such of the other Kadhis (not being less than three in number) as may be prescribed by or under an Act of Parliament, shall each be empowered to hold a Kadhi’s court having jurisdiction within the former Protectorate or within such part of the former Protectorate as may be so prescribed:
    Provided that no part of the former Protectorate shall be outside the jurisdiction of some Kadhi’s court.

    The former protectorate is the 10 mile coastal strip this is made clear in the agreement of 8th october 1963 between the UK, Kenya and Zanzibar ( at page 3).

    At law school, Kenyan Advocates in training are taught as a matter of course that the anomoly of Kadhi’s courts operating Unconstitutionally is an example of how the letter of the law being trumped by the spirit of the constitution.

    secondly, while i agree that most of this email is utter dross, very serious questions about the nature of the repulic, the secular status of the constitution and issues of national cohesion and citizen identity must be addressed as we debate the kadhi’s issue

    In 07-08 we witnessed what will remain imprinted in our minds for a long time to come. The courses of these mad scenes never witnessed before are well known to many. Instead of their senseless battles against the Kadhi’s Courts, and their never ending debates on when life begins, I challenge the X-tian clergy to emulate X-tians of goodwill such as the rational retired Rev. Timothy Njoya who literally fought for change in this country, and address the core issues such as tribalism, and stop tying to bring religious sectarianism to spice up tribalism that already exist among our people. They should also call to mind that as the rest of Kenya burned in 07-08, Muslim areas remained relatively calm with no reported cases of Mosques going up in flames because such and such tribe worship there and voted for the “wrong” candidate!!!!

    (b) possesses such knowledge of the Muslim law applicable
    to any sects of Muslims as qualifies the person, in the
    opinion of the Judicial Service Commission, to hold a
    Kadhi’s court.

    (3) Parliament shall establish Kadhis’ courts, each of which shall
    have the jurisdiction and powers conferred on it by
    legislation, subject to clause (5).

    (4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi and
    such of the other Kadhis (not being fewer than three in
    number) as may be prescribed under an Act of Parliament,
    shall each be empowered to hold a Kadhi’s court having
    jurisdiction within Kenya.

    (5) The jurisdiction of a Kadhis’ court shall be limited to the
    determination of questions of Muslim law relating to personal
    status, marriage, divorce or inheritance in proceedings in
    which all the parties profess the Muslim religion and submit
    to the jurisdiction of the Kadhi’s courts.

    Let me not be technical on this.

    If you understand English you will note that Kadhi courts are going to be legislated by Parliament. In other words the constitution only gives it a right to exist and boundaries/jurisdiction to operate in family and marriage matters.

    It does not say that a muslim who steals your money will go to Kadhi court.So those christians with so much money and vision should save their energy until after the new constitution is enacted then they can take their fight to parliament TO ENSURE that the bill of Parliament that will determine powers and functions of Kadhis fits their whims and fears.

    On the question of muslims and their fear or lack of fear. I have no problem with muslims getting rich or positions in Kenya. The greatest danger in Kenya posed by muslims is of the same weight as that posed by illegal sudanese, congolese and others. The greatest danger in terms of security is the undocumented illegal Somali muslims who are settling Kenya in large numbers.

    These ones s we have seen in Eastleigh will be a problem in future just as they are a problem in Europe today. It is not their problem though, it is the problem of the christian presidents who have refused to come up with proper and fool proof birth registration and the same christians who corruptly stole money meant for the forensic and biometric registration of persons. So as a christian blame the illegal immigration on your brothers in parliament and at Nyayo house.

    Just a questions on all this nonsense: under section 66.4 of the current constitution the jurisdiction of kadhi’s courts are restrained to the former Protectorate. It reads:
    “(4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi
    and such of the other Kadhis (not being less than three in number) as may be prescribed by or under an Act of Parliament, shall each be empowered to hold a Kadhi’s court having jurisdiction within the former Protectorate or within such part of the former Protectorate as may be so prescribed.”

    Now the Kadhi’s Courts Act 2008 Chapter 11 revised edition changed it following 66.3 of actual constitution, which asked the Parlament to rule on the matter of Kadhi’s Courts in the country. In the above mentioned Kadhi’s Courts Act 2008 Ch 11 number 4.2 the Parlament decided to enlarge the jurisdiction of the Kadhi’s Courts to all Provinces.
    Now my question is: Did they ask Kenyans if they were in agreement in such unfair and unethic decision? What the MPs did was just to introduce Kadhi’s Courts jurisdiction allover Kenya, changing the original and still actual constitution number 66.4 based on powers given to them on 66.3! Conclusion: They wrote something that seems to us good in 66.4 following what was there before. But they made sure to include a loop whole under 66.3 in order to do as they please. And this is just the waay the actual proposed draft constitution has been written… with lots os just loop wholes in order that they do as they please!
    Shame on you! Vote NO and rewrite a fair and just constitution!
